Disclosure Regarding Background Investigation

GigWheels Private Rental Car Agency ("GigWheels") may obtain information about you from a third-party consumer reporting agency ("CRA") for the purpose of evaluating your application to rent a vehicle. Thus, you may be the subject of a "consumer report" and/or "investigative consumer report" which may include information about your character, general reputation, personal characteristics, and mode of living.

These reports may contain information regarding your criminal history, motor vehicle records (MVR), driving history, sex offender registry check, identity verification, address history, and Social Security Number trace. GigWheels will not procure a consumer report or investigative consumer report about you without your written authorization.

The name and contact information of the CRA that will provide your report(s):

If GigWheels changes CRAs in the future, you will be notified before any additional consumer report is procured about you.

What Will Be Checked

The background investigation may include the following:

• 🚗 Motor Vehicle Record (MVR) — Your state driving history, license status, traffic violations, accidents, and endorsements. Required for every applicant.
• 🚔 Criminal history — SSN trace, national criminal database, sex offender registry, and county/state criminal records where applicable.
• 🪪 Identity verification — Confirmation that your name, date of birth, and Social Security Number match public records.
• 🔎 Sex offender registry — National sex offender public registry check.

Your Rights Under the Fair Credit Reporting Act (FCRA)

You have specific rights under the federal Fair Credit Reporting Act (FCRA), including but not limited to:

• The right to receive a copy of any consumer report used to make a decision about you.
• The right to dispute the accuracy or completeness of information in the report.
• The right to be notified before adverse action is taken based on a consumer report (a "pre-adverse action notice"), including a copy of the report and a summary of your rights.
• The right to a reasonable period of time (typically at least 5–7 business days) to dispute the report before final adverse action is taken.
• The right to receive a final adverse action notice if GigWheels decides not to rent to you based, in whole or in part, on the report, including the name and contact information of the CRA and a statement that the CRA did not make the decision.
• The right to a free copy of the report from the CRA within 60 days of receiving an adverse action notice.

State-Specific Notices

California, Minnesota, Oklahoma residents: You have the right to request a copy of any consumer report obtained about you. Check the box on the application form to receive a copy at no cost.

New York residents: You have the right to receive a copy of Article 23-A of the New York Correction Law, which governs employers' consideration of criminal history. A copy is available on request.

Washington State residents: You have the right to request from the CRA a written summary of your rights under Washington law.

Retention & Sharing

• Reports are retained by GigWheels for as long as your renter file remains active, plus a compliance retention period as required by law (typically 5 years).
• Reports are not shared with any third party except (a) our insurance carriers as required for coverage, (b) our attorneys or auditors under confidentiality, or (c) as required by subpoena or court order.
• Reports are stored on encrypted servers accessible only to authorized GigWheels admin staff.

How to Consent (or Decline)

To consent to a background check as described above, return to the application and check the box marked "I authorize GigWheels to obtain a consumer report about me for rental-eligibility purposes."

If you do not consent, GigWheels will not be able to process your rental application. Consent is a condition of rental with GigWheels because we require verified driver safety for every applicant.
